Terms and Conditions

Definitions

In this document the following words shall have the following meanings:

"You"/"Your" means the person who buys Goods from us;

"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

"Goods" means the articles that you agree to buy from us;

"Us"/"We"/"Our" means Models R Go;

"Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by us;

"Website" means modelsrgo.co.uk/modelsrgo.com

General

These Terms and Conditions shall apply to all contracts for the sale of Goods by us to you and shall prevail over any other documentation or communication from you.

Acceptance of delivery of the goods shall be deemed conclusive evidence of your acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by us.

Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer.

We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website.

Prices

All prices on our Website are exclusive of any delivery, packing, insurance and other relevant charges.

Our prices include UK VAT. If you alter the shipping location to a non-EU address then prices will be displayed without UK VAT. 

The minimum goods order is £3.50 excluding shipping.

The Website contains a large number of goods and it is always possible that, despite our best efforts, some of the goods listed on the Website are incorrectly priced. We verify the prices included in your order to us as part of our processing procedures so that where goods are incorrectly priced we may, at our discretion, either contact you for your instructions in relation to your order or cancel your order and notify you of such cancellation. We will not be obliged to supply goods at the incorrect price.

We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at any time before we accept your order.

Your Order

You do not have to create an account on the Website before placing an order, but doing so will mean you will not have to enter your contact details again next time.

You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Buy now" button on the checkout page.

Our Website calculates shipping charges automatically. If you have added items to your basket you can determine the shipping cost without passing through checkout as follows: Select "View Basket" and then enter your delivery address details into the "Calculate shipping cost" box. Click "Get rates". You can then choose your required postal service. Click "Select" to display the total cost of your order including shipping.

All orders for Goods shall be deemed to be an offer by you to purchase goods pursuant to these Terms and Conditions and are subject to acceptance by us. We may choose not to accept an order for any reason.

After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Note that this email is an acknowledgement and is not an acceptance of your order.

We aim to post live stock levels on the Website. However we are not infallible. If you order goods which are not available from stock, we will contact you to discuss how you wish to proceed. You will have the option to wait until the goods are available from stock, or cancel your order in accordance with our returns policy.

Unless we have notified you that we do not accept your order or you have cancelled it in accordance with our returns policy, we accept your order 7 days after the date of the order or when the goods are delivered, whichever is earlier.

Payment

Payment of the total purchase price (including any delivery and packing charges) must be made in full before dispatch of the Goods. We only accept payments in Sterling.

If you pay via Credit/Debit card then we do not take payment until the Goods are ready for dispatch. If you use Paypal then the payment is taken immediately. Note however that Paypal may delay payment to us whilst they conduct a Payment Review. In this case, shipping will be delayed until the payment clears. We no longer accept eCheques from Paypal.

All payments are subject to validation checks. If the issuer of your card refuses to authorise payment we cannot accept your order using that card and we will not be obliged to inform you of the reason for refusal.

We are not liable for your card issuer, bank or Paypal charging you as a result of our processing of your credit/debit card or Paypal payment.

Prohibited Goods

We do not warrant that materials, items for sale on the Website are appropriate for use outside the United Kingdom. International shipping regulations prohibit us from sending certain items outside mainland UK. These items are clearly identified in the product descriptions. If you are located offshore and purchase such items then we reserve the right to remove them from your order and adjust the order value accordingly.

Were applicable law requires that you be of a certain age to purchase restricted goods (e.g. glues, solvents, knives), your placement of an order will be confirmation that you have attained the age necessary to purchase the restricted goods.  

Limited Warranties

We warrant that the Goods will at the time of delivery correspond to the description given by us at the time of ordering. Items are sold on the understanding that they are to be used for their intended purpose. We do not sell construction kits as collectables, so packaging is considered a disposable item whose only purpose is to protect the contents from damage or loss during shipping. Creasing or edge wear to packaging does not constitute damaged goods. If a pristine box is required because the kit is to form part of a boxed collection then please source your kit elsewhere.

Stock illustrations of goods on the Website are for guidance only. Manufacturers reserve the right to alter packaging at any tme, so Website illustrations may not match the packaging you receive. In addition colour swatches for paints should not be relied upon to be an accurate representation of the true paint colour since the displayed colour will depend on your monitor and browser and metallic colours cannot be shown accurately.  

We cannot warrant that the Website is free from any infection by virus or malicious activity, and so you should always ensure your anti-virus software is up to date.

We endeavour to ensure that information on this Website is correct. However we do not warrant the accuracy and completeness of the material on this Website. Material is provided 'as is' without any conditions, warranties or other terms of any kind.

Limitation of Liability

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury, however we shall not be liable for any direct loss or damage suffered by you or any third party howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.

We shall not be liable under any circumstances to you or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by you or any third party howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise in connection with this Website in any way or in connection with the use, inability to use or the results of use of this Website, any websites linked to this Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, browsing this Website or your downloading of any material from this Website or any websites linked to this Website.

Licence

We grant you a limited license to access and make personal use of this Website and not to download (other than page caching) or modify it, or any portion of it, except with our express written consent. This license does not include any resale or commercial use of this site or its contents: any collection and use of any product listings, descriptions, or prices: any derivative use of this site or its contents: any downloading or copying of account information for the benefit of another merchant: or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

You may not frame or utilise framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Models R Go, ScaleXtra and our associates without our express written consent. You may not use any meta tags or any other ":hidden text": utilising our name or trademarks without our express written consent. Any unauthorised use terminates the permission or license granted by us.

You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the Website home page so long as the link does not portray us, our associates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter and does not imply any endorsement by us of your products and/or services.

You may not use any of our logos or other proprietary graphic or trademarks as part of the link without our express written permission. 

Service Access

Whist we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or reasons beyond our control.

Visitor Material and Conduct

Other than personally identifiable information, which is covered under our Privacy policy, any material you transmit or post to this Website will be considered non-confidential and non-proprietary. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

Registration

To register with modelsrgo.co.uk you must be over eighteen years of age.

Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.

Responsibility for the maintenanve of current addressing and contact details rests with you. If you fail to maintain your address details and goods are returned to us because you no longer reside at the address stipulated on your account, then we reserve the right to re-charge postage costs in order to send the order to your current address (or to deduct postage costs from a refund should you choose a refund).

Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

Force Majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, acts of terrorism, war, rebellion, riot, sabotage, official strikes, lock outs, floods, lightning, accidents, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

Miscellaneous

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

You may not assign, sub-license or otherwise transfer any of your rights under these terms and Conditions.

Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999. 

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of Great Britain and the parties hereby submit to the exclusive jurisdiction of the British courts.
